Violation of Wage Law

Do not be intimidated or fearful
if you have an issue related to your pay. You have strong legal rights and options that exist to protect you, the
employee.
At the law firm of Gilman and
Pastor, we pride ourselves on offering experienced legal counsel to employees nationwide.
Employees must be paid the
minimum wages for each hour worked and paid promptly. The Federal Minimum Wage is $7.25 an hour for covered
non-exempt employees and is the lowest hourly wage an employer is required to pay an employee. States have
different minimum wages. For example, the Massachusetts minimum wage is $8.00 per hour. The wages or
commissions must be paid promptly.
Employees may also not require
employees to bear costs incident to employer's business operations, and are required to pay the employees for
work performed.
In addition, no person may
exempt himself from states laws by special contract.
It is also unlawful for any
employer to employ any person in an occupation at an oppressive and unreasonable wage. In Massachusetts, for
example, a wage of less than $8.00 per hour, in any occupation, plus applicable overtime, shall conclusively be
presumed to be oppressive and unreasonable. In no case shall the minimum wage rate be less than $.10 higher than
the effective Federal minimum rate.
