Violation of Overtime Laws

Massachusetts law mirrors the Federal Fair Labor Standards Act with respect to the definition of exempt employees and overtime pay provisions.

Under the Federal Fair Labor Standards Act, 29 U.S.C. §201, et. seq., employees must be paid overtime for working more than 40 hours in a single work week. Employees should be compensated at the rate of one and one-half times their regular rate for all hours worked in excess of forty (40) hours per week. Under most circumstances, failure to pay all required overtime will also entitle the worker to treble (multiple) damages
